Introduction

About These Terms

AquaDash is a concierge vehicle detailing service. When you reserve an appointment with us, you are reserving a specific window of our team's time, our equipment, and our location capacity, held exclusively for you. These terms describe how we honor that reservation and what we ask of our customers in return.

By booking an appointment, completing a deposit, or receiving a service from AquaDash, you agree to the terms set out in this document. Please read them in full before booking.

Plain Language Summary

A non-refundable deposit secures your appointment. Cancellations made more than 48 hours ahead of your appointment forfeit only that deposit. Cancellations made within 48 hours, or after a prior reschedule, are charged 50% of the service price. No-shows are charged the full price. We honor real emergencies. Part One: Cancellation Policy

Every AquaDash appointment is reserved exclusively for you. Our technicians, products, location capacity, and time are committed to your service the moment you book. The following terms govern how appointments may be cancelled or rescheduled, and the fees associated with each scenario.

Section 1.1: Reservation Deposit

A non-refundable deposit equal to 10% of the booked service price is required to confirm every appointment. Your appointment is not secured on the AquaDash schedule until the deposit is received.

The deposit is applied as credit toward the final service price upon completion of your appointment. The deposit is not refundable under any cancellation, reschedule, or no-show scenario, regardless of the reason. The deposit is the consideration for AquaDash holding the reserved time exclusively for you.

Section 1.2: Cancellation More Than 48 Hours in Advance

If you cancel an appointment more than 48 hours before your scheduled service start time, no further fee applies beyond the forfeited deposit described in Section 1.1.

Cancellations within this window may be made by replying to your booking confirmation, contacting us by phone at 972-632-8449, or by email.

Section 1.3: Cancellation or Reschedule Within 48 Hours

If you cancel or reschedule an appointment within 48 hours of your scheduled service start time, a fee equal to 50% of the booked service price will be charged to the payment method on file. This fee is in addition to the forfeited reservation deposit.

This applies whether the cancellation or reschedule is initiated by phone, text, email, or any other channel.

Section 1.4: Cancellation Following a Prior Reschedule

If an appointment has been rescheduled one or more times and is subsequently cancelled, at any point, regardless of how far in advance the cancellation occurs, a fee equal to 50% of the booked service price will be charged to the payment method on file.

This term reflects the operational cost of repeatedly holding reserved time across multiple reservations that ultimately did not result in a completed service.

Section 1.5: No-Call, No-Show

If you do not appear for your scheduled appointment and have not notified AquaDash of a cancellation or reschedule beforehand, the appointment is treated as a no-show. The full booked service price will be charged to the payment method on file.

An appointment is considered a no-show if the vehicle has not arrived at the service location within 20 minutes of the scheduled service start time, and no contact has been made with AquaDash to indicate a delay.

Section 1.6: Late Arrivals

If you arrive within 20 minutes of your scheduled service start time, AquaDash will make every reasonable effort to perform your full booked service. However, AquaDash reserves the right, in its sole discretion, to:

  • Reduce the scope of service performed if the remaining time is insufficient to complete the full booked tier to AquaDash quality standards;
  • Reschedule the appointment with the 50% fee in Section 1.3 applied; or
  • Proceed at the full price with the understanding that the service may be abbreviated to fit the remaining window.

The choice among these options remains with AquaDash, and is made with the goal of preserving service quality and the experience of subsequent customers whose appointments depend on our schedule.

Section 1.7: Weather & Operational Cancellations

AquaDash operates outdoors. We monitor weather continuously, and when conditions threaten the quality or safety of a service, including sustained rain, hail, lightning, sustained winds above 30 mph, or temperatures outside the operational range of our products, we may proactively reschedule appointments at no cost to the customer.

When AquaDash initiates a cancellation or reschedule for operational reasons, the deposit remains valid and is automatically applied to the rescheduled appointment. No fee is charged.

If a customer prefers to keep an appointment that AquaDash has flagged for weather concerns, AquaDash may decline to perform the service if our quality standards cannot be met. Quality is non-negotiable.

Section 1.8: Genuine Emergencies

AquaDash recognizes that medical emergencies, family emergencies, and other unforeseeable circumstances do occur. When a customer notifies us of a genuine emergency, AquaDash retains sole discretion to waive cancellation or reschedule fees on a case-by-case basis.

To request consideration, contact AquaDash at the earliest opportunity. Discretion is exercised in good faith; abuse of this provision through repeated claims will result in standard fees being applied.

Section 1.9: Method of Charging

By booking an appointment with AquaDash, you authorize AquaDash to charge the payment method on file for any deposit, cancellation fee, reschedule fee, no-show fee, or service price as described in this Cancellation Policy and the Terms of Service that follow. You will receive an electronic receipt for any charge.

You agree to maintain a valid payment method on file for the duration of any booked appointment, and to update your payment information promptly if it changes.

Part Two: Terms of Service

The following terms govern the relationship between AquaDash LLC and its customers in connection with all detailing services, communications, and digital interactions.

Section 2.1: About AquaDash

AquaDash LLC ("AquaDash," "we," "us," or "our") is a Texas limited liability company providing concierge vehicle detailing services at designated Lifetime Fitness facility locations and through related channels. Our services include the Express Shine, Luxe Shine, and Ultra Luxe service tiers, as well as Paint Correction, Ceramic Coating, and Paint Protection Film as specialty offerings.

Our service locations, hours of operation, pricing, and service catalog are published on our website and may be updated from time to time without prior notice.

Section 2.2: Acceptance of Terms

By booking an appointment, paying a deposit, providing a vehicle for service, or otherwise engaging AquaDash, you ("Customer," "you," or "your") accept and agree to these Terms of Service and the Cancellation Policy that precedes them. If you do not agree to these terms, do not book a service with AquaDash.

If you are booking on behalf of a vehicle owned by someone else, you represent and warrant that you have the legal authority to authorize service on that vehicle and to bind the vehicle's owner to these terms.

Section 2.3: Right to Refuse Service

AquaDash reserves the right to refuse, modify, or terminate any service, at any time, in our sole discretion, without obligation to state a reason. Reasons may include but are not limited to: vehicle condition that poses a risk of damage during normal detailing; suspected biohazard or contamination; abusive, threatening, or harassing behavior toward our team; suspected impairment of the customer; failure to disclose material modifications to the vehicle; or any other circumstance in which we determine that performing the service is not in the best interest of the customer, our team, or AquaDash.

Where AquaDash refuses or terminates a service, any deposit paid will be forfeited if the refusal results from customer behavior or non-disclosure. Where the refusal is at AquaDash's election for operational reasons unrelated to the customer, the deposit will be refunded or applied to a rescheduled appointment.

Section 2.4: Vehicle Access & Operation

By providing your vehicle for service, you authorize AquaDash and its personnel to access, enter, start, move, and reposition the vehicle as reasonably necessary to perform the booked service. This authority is limited to the immediate service location and the operational footprint required to complete the service.

AquaDash personnel will exercise reasonable care while operating the vehicle. AquaDash is not responsible for mechanical failures, electronic malfunctions, dead batteries, or other vehicle conditions that arise from causes pre-existing the service. You represent that the vehicle is in safe operating condition at the time of service.

Section 2.5: Pre-Existing Condition & Customer Acknowledgment

Prior to the start of any service, AquaDash conducts a vehicle intake inspection and may photograph the vehicle's condition. We will note observable pre-existing scratches, dents, paint defects, mechanical issues, interior stains, modifications, and other observable conditions in the service record.

The intake inspection is your opportunity to identify and disclose any condition you wish documented. Conditions not raised by the customer at intake are presumed to have been pre-existing and accepted as documented.

AquaDash is not responsible for any pre-existing condition, whether documented or not.

You acknowledge and agree that detailing services involve close inspection of the vehicle, and that we may identify pre-existing damage that was not previously visible. Disclosure of such damage in our service record is for your benefit and AquaDash's protection; it is not an assumption of liability.

Section 2.6: Personal Items in Vehicles

Customers are strongly encouraged to remove all valuable, fragile, sensitive, or irreplaceable personal items from their vehicle before service. AquaDash exercises reasonable care during interior service and will set aside visible personal items for return at handoff.

AquaDash assumes no liability and is not responsible for loss of, damage to, or disappearance of any personal items left inside a vehicle, including but not limited to: cash, currency, jewelry, watches, electronics, mobile phones, laptops, tablets, headphones, sunglasses, prescription glasses, prescription medications, controlled substances, firearms, ammunition, weapons of any kind, identification documents, financial documents, legal documents, business records, child seats, infant items, pet items, sentimental or family items, art, collectibles, or any other tangible property.

Items found in a vehicle and not claimed within thirty (30) days will be disposed of in accordance with applicable law.

If a firearm or any controlled substance is observed in a vehicle, AquaDash personnel will not move or handle the item, will pause service, and will contact the customer for instructions. AquaDash reserves the right to refuse service in such circumstances under Section 2.3.

Section 2.7: Assumption of Risk

You acknowledge that vehicle detailing services, while performed with professional care, carry inherent risks that cannot be fully eliminated. These risks include but are not limited to: revealing or magnifying pre-existing paint defects; aggravation of pre-existing damage that becomes more visible after cleaning; reaction of detailing products with previously-applied coatings, sealants, waxes, or aftermarket finishes of unknown specification; lifting of paint, decals, vinyl wraps, or trim that was already failing or improperly adhered; water intrusion into vehicle interiors with seals, weatherstripping, or panel gaps that were already compromised; and damage to non-OEM modifications, after-market parts, or items not disclosed at intake.

You assume the risk of these inherent conditions. AquaDash is not liable for damage that arises from latent defects, undisclosed modifications, or pre-existing conditions of the vehicle.

Section 2.8: Quality Recovery

AquaDash stands behind every service we complete. If you are not satisfied with any aspect of a completed service, please raise the concern with the technician or Lead at handoff, or contact us within 24 hours of service completion.

Where a quality concern is verified by AquaDash, we will, at our sole discretion, perform a complimentary touch-up, re-perform the affected portion of the service, or offer a credit toward a future appointment. Service recovery is offered in good faith and is not an admission of legal liability.

Quality concerns raised more than 24 hours after service are evaluated case-by-case and may not qualify for complimentary remediation, given the variables introduced by intervening use of the vehicle.

Section 2.9: Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN WRITING, AQUADASH SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." AQUADASH DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR TRADE USAGE. AQUADASH DOES NOT WARRANT THAT ANY SERVICE WILL PRODUCE ANY SPECIFIC RESULT, RESTORE THE VEHICLE TO ANY SPECIFIC CONDITION, OR EXTEND THE LIFE OF ANY FINISH, COATING, OR MATERIAL.

Specialty services such as Ceramic Coating and Paint Protection Film are governed by separate written warranties provided at the time of service, which control over this general disclaimer for those services only.

Section 2.10: Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AQUADASH'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO ANY SERVICE, CLAIM, OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE SERVICE GIVING RISE TO THE CLAIM. AQUADASH SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, LOSS OF DATA, DIMINISHED VALUE, OR RENTAL COSTS, EVEN IF AQUADASH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies regardless of the legal theory on which a claim is based, whether contract, tort (including negligence), strict liability, or otherwise. This limitation does not exclude liability that cannot lawfully be excluded under applicable Texas law.

Section 2.11: Indemnification

You agree to indemnify, defend, and hold harmless AquaDash, its members, officers, employees, contractors, and agents from and against any and all third-party claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms of Service or the Cancellation Policy; (b) your failure to disclose material conditions or modifications of the vehicle at intake; (c) the presence of contraband, controlled substances, biohazards, or unsafe items in the vehicle; (d) damage caused by latent defects in the vehicle; or (e) claims by third parties (including any owner of the vehicle other than you) arising from your authorization of service.

Section 2.12: SMS, Email & Communications

By providing a phone number or email address to AquaDash, you consent to receive transactional communications from us related to your appointment, service reminders, confirmations, follow-ups, receipts, and legal notices. These communications are necessary to deliver your booked service.

By booking with AquaDash and providing your email address, you also consent to receive email marketing communications from us, including offers, news, and updates about our services. You may opt out of email marketing at any time by clicking the unsubscribe link in any marketing email or by emailing us as described in Section 2.22. Opting out of email marketing does not opt you out of transactional communications.

Marketing text messages (SMS) are sent only with your express opt-in consent at the time of booking or in response to a written promotion. You may opt out of marketing text messages at any time by replying STOP to any AquaDash marketing text. For assistance, reply HELP or contact us at 972-632-8449. Standard message and data rates may apply, and message frequency varies.

Carriers are not liable for delayed or undelivered messages. AquaDash is not responsible for missed appointments resulting from carrier delivery failures.

Section 2.13: Privacy

AquaDash collects only the customer information necessary to deliver our services: your name, contact information, vehicle details, service history, and payment information. Our complete privacy practices are described in our Privacy Notice, available on our website.

We do not sell customer information to third parties. We share customer information only with service providers necessary to operate our business, including payment processors, scheduling software, communications providers, and similar, under terms requiring them to protect that information.

Section 2.14: Photography, Video & Marketing License

AquaDash routinely photographs and video-records vehicles before, during, and after service for purposes including documentation of vehicle condition, quality assurance, training, social media content, advertising, and marketing.

By booking an appointment with AquaDash, you grant AquaDash a perpetual, irrevocable, royalty-free, worldwide, transferable, sublicensable license to capture, edit, reproduce, distribute, display, publish, and otherwise use such photographs, videos, and other recordings of your vehicle in any medium, in any form, and through any channel, including social media, advertising, our website, printed materials, and third-party platforms, without further consent and without compensation to you.

AquaDash will obscure license plates and other directly identifying details before publishing any image of a vehicle externally. AquaDash will not externally publish images that show identifiable personal items inside a vehicle or the interior of a personal residence.

This license covers the vehicle and the work performed on it, and does not extend to images in which a customer or other identifiable person is the focus of the image; AquaDash will obtain separate consent before publishing images in which a person is identifiably featured.

If you do not wish for images of your vehicle to be used in external marketing, you may request to be excluded by emailing us before or after the service. We will honor exclusion requests for content captured on or after the date of the request, but cannot reasonably retract content already published prior to receiving the request.

Section 2.15: Tips & Gratuities

Tips and gratuities offered to AquaDash personnel are voluntary, non-refundable, and not part of the service price. AquaDash does not solicit tips and does not require them. Tips received are handled in accordance with AquaDash's internal compensation policies.

Section 2.16: Force Majeure

AquaDash is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: severe weather; natural disasters; acts of God; acts of government; closure of host facilities (including Lifetime Fitness or other partner locations); utility failures; pandemic-related restrictions; civil unrest; labor disputes; supply chain disruptions; or failures of third-party software or telecommunications providers. Where such circumstances arise, we will work in good faith with customers to reschedule.

Section 2.17: Modifications to These Terms

AquaDash reserves the right to modify these Terms of Service and the Cancellation Policy from time to time, in our sole discretion. The version of the terms in effect at the time you book an appointment governs that appointment. The current version is published on our website.

Material changes to these terms will be communicated to active customers by email or text in advance of taking effect. Your continued use of AquaDash services after a modification constitutes acceptance of the modified terms.

Section 2.18: Governing Law & Dispute Resolution

These Terms of Service and the Cancellation Policy are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

The parties shall first attempt to resolve any dispute arising under these terms through good-faith direct discussion. If a dispute cannot be resolved within thirty (30) days of written notice from one party to the other, the parties agree to submit the matter to non-binding mediation in Collin County, Texas, before initiating any legal proceeding. Each party shall bear its own costs of mediation, and the mediator's fees shall be split equally.

Any legal proceeding not resolved through mediation shall be brought exclusively in the state or federal courts located in Collin County, Texas, and the parties consent to the personal jurisdiction of those courts and waive any objection to venue in those courts.

Section 2.19: Class Action & Jury Trial Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND AQUADASH EACH AGREE TO BRING ANY DISPUTE ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. YOU AND AQUADASH EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR ANY AQUADASH SERVICE.

Section 2.20: Severability

If any provision of these terms is found by a court of competent jurisdiction to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Section 2.21: Entire Agreement

This document, together with any service-specific addenda signed at the time of booking, the Privacy Notice referenced in Section 2.13, and any written warranty provided in connection with a specialty service, constitutes the entire agreement between AquaDash and the customer with respect to the services described herein, and supersedes any prior or contemporaneous representations or understandings, whether oral or written.

Customer Acknowledgment

By booking an appointment with AquaDash LLC, the customer acknowledges that they have read, understood, and agree to the AquaDash Terms of Service and Cancellation Policy set out in this document.

This acknowledgment is captured electronically at the time of booking.
